Wedding Photography Services Agreement

1. Booking & Retainer

A non-refundable retainer of 50% is required to secure the session date. The remaining balance is due on the last business day prior to the scheduled session.

2. Cancellations & Rescheduling

Cancellations within 1 days of the session will result in forfeiture of the retainer. Failure to attend the session without notice constitutes a cancellation. Rescheduling can take place at no additional cost, subject to availability.

3. Weather Policy

If weather conditions make the session unsafe or impossible, the session may be rescheduled at no additional charge (subject to availability).

Refunds will not be issued due to weather unless the Photographer is unable to reschedule.

4. Client Lateness

The session will begin and end at the scheduled time.

Clients arriving late will have their session time reduced accordingly. The full session fee remains applicable.

If a client is more than 15 minutes late, the Photographer reserves the right to modify or cancel the session if lighting conditions no longer permit completion.

Delays caused by third-party vendors (including hair stylists, makeup artists, transportation services, or planners) are the responsibility of the Client and do not extend session time.

5. Artistic Style

Client acknowledges that they are familiar with the Photographer’s portfolio and style. Editing decisions are made at the Photographer’s artistic discretion.

RAW files are not provided.

6. Image Delivery & Archiving

Proof galleries will be delivered for image selection. Clients must select images within three (3) months of gallery delivery.

Unselected images may be permanently deleted after three (3) months.

Final edited images are delivered as high-resolution JPG files.

The Photographer is not responsible for archiving images beyond six (6) months after final delivery.

7. Copyright & Usage

The Photographer retains full copyright of all images.

Clients are granted a personal-use license for printing and sharing. Images may not be sold, altered, or used for commercial purposes without written consent.

8. Model Release

Client grants the Photographer permission to use images for portfolio, website, social media, marketing, and publication unless otherwise requested in writing prior to the session.

9. Limitation of Liability

In the unlikely event of equipment failure, loss of digital files, or technical malfunction, liability is limited to the total amount paid.

The Photographer is not responsible for compromised coverage due to late arrival, weather conditions, location restrictions, or interference by third parties.

Client assumes all responsibility for personal safety during the session. The Photographer is not liable for injuries, accidents, or damages occurring at the location.

10. Force Majeure

The Photographer shall not be liable for failure to perform due to causes beyond reasonable control, including but not limited to hurricanes, storm warnings, government restrictions, illness, travel disruptions, or other acts of God.

11. Child Safeguarding

For sessions involving minors, a parent or legal guardian must be present. The Photographer complies with Cayman Islands child protection laws and is legally obligated to report reasonable concerns regarding a child’s welfare.

12. Conduct

Disrespectful, abusive, or inappropriate behaviour toward any person will result in termination of the session without refund.

13. Mobile Phones & Guest Photography

To ensure the best possible results and an efficient session flow, Clients agree to minimize the use of mobile phones and personal cameras during the session.

Guests and family members may not photograph or record simultaneously while the Photographer is actively shooting, as this may distract subjects and interfere with composition, and direction.

The Photographer reserves the right to pause the session if excessive phone use or interference affects the session quality.

The Client is responsible for ensuring that accompanying guests comply with this policy.
